4.1 Wallet Responsibility: • You are solely responsible for maintaining the security of your cryptocurrency wallet and private keys • We do not store, have access to, or control your private keys or wallet funds • You acknowledge that loss of private keys may result in permanent loss of access to your digital assets 4.2 Wallet Compatibility: The DApp supports various wallet providers. We are not responsible for the functionality, security, or terms of use of third-party wallet services. 4.3 Transaction Authorization: By connecting your wallet and authorizing transactions, you confirm that you understand the nature and consequences of blockchain transactions, including their irreversible nature.
5. Smart Contracts and Blockchain Interactions
5.1 Smart Contract Risks: • Smart contracts are deployed on the blockchain and operate autonomously • We cannot modify, reverse, or control smart contract executions once deployed • You acknowledge the inherent risks of smart contract interactions, including potential bugs or vulnerabilities 5.2 Gas Fees and Transaction Costs: • All blockchain transactions require network fees (gas fees) • You are responsible for all transaction fees associated with your use of the DApp • Gas fees are determined by the blockchain network and are subject to fluctuation 5.3 Transaction Finality: Blockchain transactions are immutable and irreversible. 7. Intellectual Property Rights
7.1 Our Rights: The DApp, including its design, code, and content, is protected by intellectual property laws. We retain all rights, title, and interest in the DApp. 7.2 License to Use: We grant you a limited, non-exclusive, non-transferable license to access and use the DApp in accordance with these Terms. 7.3 User Content: You retain ownership of any content you create or upload. 8. Disclaimers and Warranties
8.1 No Warranties: THE DAPP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. 8.2 Blockchain Disclaimers: • We do not guarantee the performance, reliability, or availability of blockchain networks • Network congestion, forks, or other blockchain issues may affect Service availability • Digital asset values are highly volatile and speculative 8.3 Third-Party Services: We are not responsible for the performance, security, or reliability of third-party services, including wallet providers, blockchain networks, or external protocols.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: 9.1 Exclusion of Damages: WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE. 9.2 Liability Cap: OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) $100 USD OR (B) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM. 9.3 Blockchain-Specific Limitations: WE ARE NOT LIABLE FOR: • Loss of digital assets due to user error, private key loss, or wallet compromise • Smart contract bugs, vulnerabilities, or malfunctions • Blockchain network failures, forks, or attacks • Regulatory changes affecting digital asset legality or use
